Nick Diaz Not Retired After All? Stockton’s Finest Suing NSAC For Due Process, Says He’s Ready To Fight Immediately

MMA Fighting has broken a fairly remarkable story; Nick Diaz is fighting for his right to … well … fight. The former Strikeforce welterweight champion, and challenger to the UFC welterweight championship, is suing the Nevada State Athletic Commission for two different things.

Diaz’s first complaint cites breach of statute NRS 467.117, which requires that a “temporary suspension may be made only where the action is necessary to protect the public welfare”. In other words, Diaz’s temporary suspension is unlawful because no basis has been established that demonstrates suspending Diaz was done as a matter of preserving public health. His other complaint is that his Due Process rights under the Constitution are being violated as well considering he’s been suspended going on two months right now and has yet to have a meeting in front of the NSAC.
