A tentative trial date has been set for the man accused of plotting to kidnap David Letterman’s son.

Kelly Frank, 43, goes to trial Monday, July 18. Police charged him with a felony count of solicitation to kidnap and a misdemeanor count for initially lying to an FBI agent according to AP. On top of that he’s also faces a charge of felony theft for overcharging the late-night talk show host for painting his Montana ranch.

Frank, a convicted felon, was already on probation for a felony intimidation conviction at the time of the incident. He allegedly approached acquaintance named Robert Gondeiro about kidnapping Letterman’s son and the child’s nanny. According to police, Frank’s plan was to hold the 17-month-old child, for 48 hours for a $5 million ransom.

Reports say that Frank actually admitted he broached the subject to Gondeiro, that he had studied the layout of Letterman’s home and his schedule of comings and goings and that he had a key to the 2,700-acre home.

Frank entered a not guilty plea on Tuesday, April 19, to all three charges. Currently he is being held on $650,000 bail.

Letterman’s longtime girlfriend, Regina Lasko, gave birth to his son, Harry Joseph in November 2003.
