Texan’s woner Bob McNair made an appeal on behalf of Cushing, but it was denied.
Cushing claims he he has a unique medical condition stemming from something called overtrained athlete syndrome and that is what McNair told NFL Commissioner Roger Goodell in a meeting last month.
However, the NFL announced Thursday that the four-game suspension for testing positive for HCG will stand.
