MLB News: Andrew Gallo Found Guilty In Nick Adenhart Death

The jury came to the decision Monday evening.

The verdict was the second DUI conviction for Gallo, he was also convicted on three counts of second-degree-murder, hit and run, and drunk driving and causing great bodily harm.

Gallo’s sentencing is scheduled for December 10 and he will face between 50 years and life in prison. Gallo’s attorney is expected to appeal because she feels the DA didn’t have the right to pursue murder charges.

Prosecutors said they charged the case as a second-degree murder instead of the lesser charge of manslaughter because Gallo had a previous DUI conviction, had specific knowledge of the dangers of drinking and driving from his own experience, and had signed a court form from the earlier case saying he understood he could be charged with murder if he drove drunk again and killed someone.

According to court documents, Gallo had been drinking for hours before running a red-light and running into a car carrying Nick Adenhart, Henry Pearson, Courtney Stewart, and Jon Wilhite. Wilhite was the only survivor from that car. The accident happened just hours after Adenhart made his season debut, pitching 6 scoreless innings.
